Terms of Service
These Terms govern your use of the PotholePro iOS application, this marketing website, and any related services we provide. By downloading, accessing, or using the app or site, you agree to these Terms. If you do not agree, do not use the services.
1. The service
PotholePro provides software tools for trip logging, road-hazard style detection, maps, reports, and optional integrations with infrastructure you configure (for example a Supabase project). Features may change between releases. We may suspend or discontinue any part of the service with reasonable notice where practicable.
2. Eligibility & Apple terms
You must be able to form a binding contract in your jurisdiction. If you access the app through Apple’s App Store, your use is also subject to Apple’s applicable terms of service (EULA) and App Store rules, including payments and refunds handled by Apple.
3. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded devices you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
4. Your responsibilities
- Safe driving: You must obey traffic laws. Do not interact with the app in any way that distracts you while operating a vehicle where prohibited.
- Accurate configuration: If you connect third-party services, you are responsible for securing API keys, complying with their terms, and paying their fees.
- No misuse: You may not reverse engineer (except where law permits), interfere with or overload the services, gain unauthorized access, submit fraudulent locations, harass others, or violate applicable law.
5. User content
You retain rights to content you create in the app. You grant us a limited license to process that content solely to operate and improve the services you request—for example rendering maps on your device or transmitting data you explicitly configure to your backend.
6. Third-party services
The app may interoperate with Supabase, mapping tiles, or other third parties. Their terms and privacy policies apply. We are not responsible for third-party outages or changes.
7. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. PotholePro does not guarantee detection accuracy, completeness of maps, or fitness of trip cost estimates for tax, reimbursement, insurance, or legal purposes. Detections and scores are informational only.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE OR OUR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THAT CASE OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Indemnity
You will defend, indemnify, and hold harmless PotholePro and its affiliates, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the services, your violation of these Terms, or your violation of others’ rights.
10. Governing law & disputes
These Terms are governed by the laws of the jurisdiction where PotholePro’s operator is organized, excluding conflict-of-law rules, unless mandatory consumer protections in your country require otherwise. Courts in that jurisdiction have exclusive jurisdiction, subject to non-waivable rights you may have as a consumer to sue in your home courts. Replace this section with counsel-approved governing law and venue for your legal entity.
11. Changes
We may modify these Terms from time to time. We will post updates on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance.
